Reasons for Delays in Probate Administration:
- Objections (contesting a will) - this can occur because of a basic family feud. When beneficiaries do not get along or speak to each other, the personal representative may be forced to go to court to get permission from the judge for even small matters. If the will gets contested, it can take years for the validity of the will to be sorted.
- Multiple Wills Found - when more than one will is found, it may take time for the Court to decide which is the most current and complete wishes of the deceased person.
- Requesting Supervised Administration - is a formal probate situation where the court must supervise the entire probate process and approve all of the distribution of property and this can happen when there are disagreements or disputes (even in an unsupervised probate case in Florida the judge must approve of the actions taken by the personal representative).
- Sale of Real Estate
- Sale of a Business
- Delay in filing correct paperwork - reasons could include the executor has passed away themselves or the deceased person owns property in different locations and probate must be filed in the proper counties and states.
- Executor unable to fulfill obligations - this can include the person who was appointed the personal representative may have other obligation which interfere with their duties or it could be the person appointed is disorganized, bad with money, or unwilling to perform necessary responsibilities.
